Gov't says 'no' to tribunal against Gani and Musa

The government has rejected calls for a tribunal to probe accusations of alleged misconduct against Attorney-General Abdul Gani Patail and former inspector-general of police Musa Hassan.

This was despite former Commercial Crimes Investigation Department (CCID) chief Ramli Yusuff’s, and former Kuala Lumpur CID chief Mat Zain Ibrahim’s willingness to testify at a tribunal against the two should the government decide to call for it.

On Saturday, Malaysiakini also reported that besides the two, several police officers had approached the news portal expressing their willingness to testify in a tribunal.
Malaysiakini reported last week that then deputy home minister Johari Baharom had instructed Ramli to investigate Johor-based money laundering kingpin Goh Cheng Poh, who is alleged to have links to Musa.

ramli yusuff asset declare case 120310 03According to Ramli (right), his investigations revealed that Musa was in cahoots with Goh and allegedly assisted in covering up Goh’s illegal gambling and money-laundering business.

Gani was accused of having instructed the then Anti-Corruption Agency (ACA) to access highly confidential files on the case and the ACA officers were allegedly ordered to hunt down informants against Goh and coerce them into changing their statements to implicate the CCID team investigating the case.

Meanwhile, Mat Zain, who on Friday had come forward to say he was willing to testify in a tribunal against Gani and Musa over fabricating evidence in the ‘black eye’ case involving Anwar Ibrahim, also praised the police officers’ willingness to testify against Gani and Musa.

Mat Zain said although he does not know who the police officers were or what they may have to say, he is confident that their testimony would see the truth be told as what was done in the royal commission of inquiry on the ‘black-eye’ incident.

“I do not know who they are or what they have but one thing is certain, when it comes to giving evidence before an RCI, I have no doubts they will tell the truth even if it is against the IGP himself.

“The case in point is during the black-eye RCI. All the police witnesses were commended for their truthfulness when giving their evidence during that proceedings. It’s in the RCI records,” he said.

Mat Zain advised that the police officers who want to testify to examine what evidence they have against the duo and if what they have are mere allegations about the “indiscriminate use of the AG’s discretionary powers”, then they may have some problems in proving their case.

“If exercising the discretionary powers is the issue, then the AG can take shelter behind Article 145, like what he has been doing all this while and getting away with it.

“They cannot nail him using this issue. It’s not easy to prove ‘bad faith’ on the part of the AG whenever he exercises his discretionary powers. We have to accept this fact no matter how much we hate it,” the former KL CID chief said.

However, he noted, if what those officers have are about the commission of criminal offences, either minor or major, then they are spot on as the AG or the IGP are like anyone else with no powers or rights to commit crimes.

“If those officers really have such evidence in their possession to prove that both Gani and Musa have indeed committed criminal acts, why not bring them on. Never mind if the offences occurred 10 or 13 years ago, they are still valid.”

Criminal offences which the duo have been linked to are planting false evidence, perjury, fabricating evidence in an investigation and using false evidence in judicial proceedings, just to name a few.

Mat Zain said he does not want to speculate on the nature of the police officers’ evidence but he is certain they know the law and would not take any risks.

“As far as the black-eye investigation is concerned, I maintain my position that both Gani and Musa have no defence. I stand to be proven wrong by the duo,” added Mat Zain.
