Following
the Kuala Lumpur High Court ruling yesterday, the move to appoint
Felda chairperson Isa Samad as a member of the Koperasi Permodalan
Felda Bhd (KPF) board did not take place at its annual general meeting
today.
In fact, Isa was missing from the KPF meeting. This was despite there being an item on the agenda that the former Negri Sembilan menteri besar was to be nominated as a board member at the AGM.
According to a KPF delegate, Isa’s name was proposed as a board member during the meeting, but the nomination was rejected on basis of the High Court granting an interim stay on Isa’s membership in KPF.
High Court judge Abang Iskandar Abang Hashim yesterday granted four Felda settlers leave to initiate judicial review proceedings against the Malaysian Cooperative Societies Commission’s (MCSC) May 23 decision that Isa's membership in KPF remains intact.
The judge had also allowed an interim stay (temporary freeze) on Isa’s status as a KPF member.
Under the KPF by-laws, Felda can appoint three nominees from its board, who are also KPF members, to the KPF board. Checks on the meeting agenda showed Isa's name listed as one of the three nominees but in the end, only two of those nominated were appointed.
There was tight police security presence at the start of the AGM. A total of 1,192 KPF delegates attended the meeting.
Also present was Felda director-general Dzulkifli Abdul Wahab, whom Isa was supposed to replace on the board. KPF is the largest co-operative in the country and it was initially mooted to be part of the Felda Global Ventures Holdings proposed listing exercise.
Isa's membership in KPF has been challenged by the four Felda Jengka settlers - Abdul Talib Ali, Abdul Mubin Abdul Rahman, Abdul Razak Mohammad and Muhamad Nor Atan.
They are seeking a declaration that the MCSC is wrong in maintaining that Isa's appointment as KPF chairperson remains intact despite it declaring his membership as illegal.
A three-member panel of the MCSC ruled on May 23 that while KPF violated its by-law in approving Felda chairperson Isa Samad’s membership application, Isa could remain a member as there was no provision in its by-laws to revoke the membership.
PKR secretary-general Saifuddin Nasution first raised the issue that the KPF board of directors had accepted Isa into the board against the rules and regulations governing cooperatives.
Later, Domestic Trade, Co-operatives and Consumer Affairs Minister Ismail Sabri Yaakob also declared that he himself had backed Isa's appointment by using his ministerial powers.
